HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.43353 of 2016 O R D E R :
The Writ Petition is filed under Article 226 of the Constitution of India seeking to issue a writ or order, more particularly one in the nature of writ of Certiorari calling for the records pertaining to the order in Crl.M.P.No.2080 of 2016 of the VII Metropolitan Magistrate, Cyberabad at Rajendranagar in Crime No.1145 of 2016 of the Station House Officer, Rajendranagar Police Station, whereby the learned Magistrate dismissed the petition filed by the petitioner seeking a direction to the investigation agency to deposit the amount of Rs.23,93,000/- and to grant interim custody of the same to him, and set aside the same and consequently allow the Crl.M.P.No.2080 of 2016 in the Court of the VII Metropolitan Magistrate, Cyberabad at Rajendranagar in Crime No.1145 of 2016 of the Station House officer, Rajendranagar Police Station.
When the matter is posted for hearing, it is informed by the learned Assistant Government Pleader for Home that the said amount which is in the nature of old Rs.500/- and Rs.1,000/- notes has already been deposited in the Court.
Hence, as the said amount has already been deposited in the concerned court by the officials concerned, this Court is not inclined to interfere with the impugned proceedings. In any event, the petitioner is at liberty to prefer fresh application before the Court concerned for return of the money or, seek for converting the said amount as a fixed deposit in the name of petitioner for some period to enable him to get the benefits of the said amount.
Accordingly, the Writ petition is disposed of at this stage. Miscellaneous petitions pending in this petition, if any, shall stand closed. _______________________ JUSTICE RAJA ELANGO 19.12.2016 skmr
