HCJ&AAR,J JUDGMENT: (Per the Hon'ble the Chief Justice Sri Raghvendra Singh Chauhan) The appellant-husband has filed the present appeal against the judgment dated 07.03.2019 passed by the learned Judge, Additional Family Court, Hyderabad, in O.P.No.1599 of 2016 (with counter-claim), whereby the learned Judge had allowed the counterclaim filed by the respondent-wife for restitution of conjugal rights, and dismissed the petition for divorce filed by the appellanthusband. Aggrieved by the said judgment, the appellant-husband has filed the present appeal, and another appeal, namely F.C.A.No.80 of 2019, before this Court. During the pendency of the appeals, the parties have entered into a compromise. In F.C.A.No.80 of 2019, they have filed an application, under Section 13-B of the Hindu Marriage Act, 1955 ("the Act", for short), which has been allowed today by this Court.

In the light of the divorce granted on the basis of mutual consent under Section 13-B of the Act, this appeal has become infructuous; it is, hereby, dismissed as infructuous. There shall be no order as to costs.
