Petition filed under Sections 438 of Cr.P.C. praying that in the circumstances stated in the Grounds of Criminal Petition, the High Court may be pleased to enlarge the Petitioner/Accused on bail in the event of his arrest in connection with the Crime No. 220 of 2017 of P.S. Godavarikhani - ll Town, Peddapalli District, in the interest of .justice The petition coming on for hearing, upon perusing lhe memorandum of grounds filed in support thereof and upon hearing the arguments of Sri Kotagiri Sreedhar, Advocate for the Petitioner and of Public Prosecuto(TS) on behalf of RespondentState, the Court made the following ORDER :-

This petition is filed, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C.'), seeking for grant of anticipatory bail to the petitioner-accused in Crime No. 220 of 2Ol7 of Godavarikhani II Town Police Station, Peddapalli District, registered for the offences punishable under Sections 409, 420 and 506 (2) IPC read with Section 156 (3) Cr.P.C. 2.
Heard learned counsel for the petitioner and learned Public Prosecutor (T.S.).

This case was registered on a private complaint filed by the complainant. The allegatio are that the petitioner ns director of one software approached the complainant as a company and believing his words, the complainant invested huge amounts in his company and that later, he asked for refund of the amount, towards which a cheque was issued by the petitioner which was, however, dishonoured. Later, the allegation is that the accused came with unsocial elements to settle the matter and threatened the complainant with dire consequences.

Learned counsel for the petitioner submits that the complainant and the petitioner are friends and that there is a marital dispute between the petitioner and his wife and hence, this complaint is filed with baseless allegations. He also relies on the list of witnesses mentioned in the complaint, wherein Kolipaka Vani (L.W.4) is no other than the wife of the petitioner. Learned counsel further submits that a notice was issued by the
complainant under Section 138 of N.I. Act and without filing any complaint for dishonour of the cheque, ne fiteO the present complaint.

The above facts would throw a doubt on the veracity of the contents of the complaint. Hence, considering the above, this l Court is inclined to grant anticipatory bail to the petitioner. 6.
The petitioner is directed to surrender before the Station House Officer, Godavarikhani II Town Police Station, Peddapalli District, within fifteen days from the date of this order. On such surrender, the petitioner shall be released on bail on his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction oF the said Station House Officer. Further, on such release, the petitioner shall abide by the conditions mentioned under Section 438(2) Cr.P.C. as under: (i) The petitioner shall make himself available for interrogation by a police officer as and when req u ired .
(ii) The petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
(iii) The petitioner shall not leave India without the previous permission of the Court.

The criminal petition is accordingly allowed. Pending miscellaneous petitions if any shall stand closed in consequence. Sd/..T.YA ASSIS'tAN'I'
