HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2636 OF 2017 ORDER:
The case of the petitioners is that they are the owners and pattadars of the land in Sy.Nos.404/1A, 450/1A, 117/8, 457/2, 116/1A, 116/4AA, 449/1A, 457/3, 452/8B, 2/3A situated at Dharmaraopet Village and Sy.Nos.79/1A, 79/2A at Padmajiwadi Village, Sadashivanagar Mandal, Kamareddy District. While so, the Electricity Department, without issuing prior notice to the petitioners as per the provisions of Electricity Act, 2003, (for short 'the Act') are laying High Tension (HT) Electricity Lines. It is also stated that the petitioners suffered heavy crop damage while installation works were going on and the respondents have also not determined the loss and fixed the compensation following Section 16 of the Act. In respect of the same, the petitioners made representation before the 1st respondent requesting to consider their case as per the guidelines issued on 15.10.2015 by the Ministry of Power, Government of India for payment of compensation. As no action has been taken, the present writ petition is filed.
Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue. In view of the above facts and circumstances, the 2nd respondent is directed to consider the representation of the petitioners and dispose of the same in accordance with law,
after issuing notice to the affected parties. The said exercise shall be done within a period of three (03) months from the date of receipt of copy of this order.
With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending if any, shall stand closed. _________________________ A.RAJASHEKER REDDY,J 01.02.2017 dv
