THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.10317 of 2017 ORDER:
Petitioner joined service on 02.04.1993 as Assistant Executive Engineer and presently working in the cadre of Deputy Executive Engineer. According to petitioner, as he was suffering from illness since long time he had to be on leave continuously. According to him, in the year 2014 petitioner made effort to join back to duty, but his health condition did not permit him to rejoin in duty. Having regard to his prolonged leave and the health condition, he had finally decided to quit the employment and accordingly made a representation on 27.02.2017 to regularize his absence and permit him to retire from service on voluntary retirement basis. Alleging inaction on said representation, present writ petition is filed.
The fact that the petitioner made request seeking voluntary retirement only on 27.02.2017 is not in dispute. Therefore, it cannot be stated that there was inaction on the part of the respondents in considering his request.
However, having regard to the claim of the petitioner that he is unable to perform duties and wants voluntary retirement, this Writ Petition is disposed of directing the respondents to examine the request of the petitioner made on 27.02.2017, pass appropriate orders assigning reasons in support of the decision and communicate the decision to the petitioner within a period of six weeks from the date of receipt of a copy of this order.
Miscellaneous Petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. _____________________ P.NAVEEN RAO, J 24th March, 2017.
