THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11574 of 2015 ORDER:

This Criminal Petition is filed by the petitioner-accused No.11 under Sections 437 and 439 Cr.P.C. seeking to grant bail to him in Crime No.367 of 2015 on the file of III Town (L & O) Police Station, Rajahmundry, registered for the offence punishable under Sections 366-A, 370, 370(A), 372, 373, 376(D) IPC and Section 6 of the Protection of Children from Sexual Offences Act and Sections 5 and 6 of the Immoral Traffic (Prevention) Act r/w 34 IPC.

Heard and perused the material available on record. It is alleged that A1 to A4 forcibly kidnapped the victim and took her to the house of A1, kept her in a room, in which two other girls were confined. On 12.8.2015, they took the victim and other girls to Bhimavaram and sold them for the purpose of prostitution to A7 and A8, who are maintaining a brothel house. A7 and A8 made the victim and other girls to commit intercourse with several persons for money. On 23.8.2015 A1 to A4 came to Bhimavaram and took the victim to A1's house, where they raped her by using condoms and they along with A5 took the victim to Kakinada and sold her to A9. A9 used the victim for prostitution for 11 days. Again she was brought back to Rajahmundry and confined in A10's house.

A10 took her for prostitution and made her to commit sexual intercourse with several others. Again on 14.9.2015, A1 to A4 shifted and handed over her to A1's uncle by name Prem and after that, A11 also used her for one day and thereafter, when she refused and threatened to commit suicide. A11 brought the victim to Rajahmundry and dropped her at bus stand. She returned to her house. Learned Public Prosecutor submitted that the bail application moved by coaccused was dismissed and that the case against the petitioner is also on the same footing as that of the other accused, whose bail application was dismissed. Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner.

Accordingly, the Criminal Petition is dismissed.
