HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT APPEAL No.440 OF 2018 JUDGMENT: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) After arguing for some time, Sri Sai Sanjay Suraneni, learned counsel for the appellant-writ petitioner, would seek two months further time for the appellant-writ petitioner to vacate the subject premises.

Learned Government Pleader for Endowments would submit that the order under appeal was passed on the basis of an undertaking affidavit dated 01.11.2017, whereby the appellant-writ petitioner undertook to vacate the subject premises by 31.01.2018; and the Learned Single Judge had, in fact, granted them two months further time till 31.03.2018 to vacate the subject premises. As the appellant-writ petitioner had, themselves, submitted an undertaking to this Court to vacate the subject premises by 31.01.2018, they cannot now seek further extension of time beyond 31.03.2018 to vacate the subject hotel which, admittedly, belongs to the 5th respondent-temple.

We see no reason, therefore, to interfere with the order under appeal. The appeal fails and is, accordingly, dismissed. No order as to costs. Miscellaneous Petitions, if any pending in this Writ Appeal shall also stand closed.
