As could be seen from the proceeding sheet dated: 24-10-2011, this Petition was admitted and the petitioner obtained interim stay in Criminal M.P. No.11279 of 2011 on the same day ie., on 24.10.2011. Further, the proceeding sheet order dated: 02.11.2017 go to show that since none appeared for petitioner, the Petition was ordered to be posted under the caption of "For Dismissal" and accordingly, the Petition was dismissed for default on 13-11-2017. 2.

Thereafter, I.A. No.1 of 2018 in CRLP.No.10249 of 2011 is filed to set aside the default order dated: 13-11-2017. When the IA is posted to 6.2.2018, on that day also none appeared for the petitioner and it was ordered to be posted under the caption of "For Dismissal". Today, in spite of posting the matter under the caption of "For Dismissal", none appeared for the petitioner and there is no representation, which clearly established that the petitioner has no interest to prosecute the matter and is not acting diligently. Hence, the Criminal Petition is dismissed for non-prosecution. 3.

Consequently, Miscellaneous Petition/ s, if any, pending, shall stand dismissed.
