THE HON'BLE SRI JUSTICE P.KESHAVA RAO CRLRC.No.2270 of 2017 ORDER:

The present Criminal Revision Case is filed questioning the judgment passed in Criminal Appeal No.1204 of 2014 dated 13.07.2014 on the file of Additional Metropolitan Sessions Judge, for trial of Communal Offence Cases-cum-VII Additional Metropolitan Sessions Judge, Hyderabad, confirming the judgment in CC.No.103 of 2014 dated 28.11.2014 on the file of XV Special Magistrate, Erramanzil, Hyderabad, convicting the petitioner for the offences under Section 138 of Negotiable Instruments Act.

During the pendency of the present Criminal Revision, it appears that the petitioner and the 1st respondent have settled the matter out of Court and the amounts have been paid to the 1st respondent-complainant by selling the plots standing in the name of petitioner herein and also by transferring some plots (600 sq.yards) in favour of 1st respondent herein.

In those circumstances, applications I.A.Nos.2 and 3 of 2018 have been filed by the parties to this Criminal Revision Case seeking permission of the Court to enter into compromise and to record the said compromise entered by

them, and set aside the judgment passed in Criminal Appeal No.1204 of 2014.

The parties have been identified by their respective counsel and the Xerox copies of the Aadhar card and driving license of the 1st respondent and the petitioner have been filed and the same are placed on record.

In those circumstances, both the applications I.A.Nos.2 and 3 of 2018 are allowed.

For the above reasons, the Criminal Revision Case is allowed setting aside the judgment in Crl.A.No.1204 of 2014 dated 13.07.2014 on the file of Additional Metropolitan Sessions Judge, for trial of Communal Offence Cases-cum-VII Additional Metropolitan Sessions Judge, Hyderabad, and the judgment dated 28.11.2014 in CC.No.103 of 2014 on the file of XV Special Magistrate, Erramanzil, Hyderabad, 7.

Miscellaneous petitions, if any, pending, shall stand closed.
