HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.26226 of 2016 ORDER:

This writ petition is filed challenging the impugned order in Procs.Rc.No.B/143/2016, dated 13-05-2016 for mutation of the name of the 5th respondent in the revenue records in respect of the land in Sy.Nos.5, 10, 12, 14, 91, 96 and 97 situated at Ramavaram Village and Mandal, Warangal District, without following the procedure.

Learned counsel for the petitioner submits that the impugned order has been passed without following due process of law, only in view of dismissal of suit filed by the petitioner in O.S.No.285 of 2010 on the file of I Additional Senior Civil Judge at Warangal against the 5th respondent and though the petitioner's name appearing in revenue records earlier.

Though notice is issued and served on the 5th respondent, there is no appearance for him.

A perusal of the impugned order dated 13-05-2016 shows only on the dismissal of suit filed by the petitioner, it has been passed. It appears that no notice was issued to the petitioner. In view of the same, the impugned order is set aside. However, this will not preclude the competent authority from taking action after issuing notice to the petitioner as well as to the 5th respondent.

Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
