CRIMINAL PETITION NO. 14995 OF 2016 O R D E R :

This Criminal Petition is filed by the petitioner/A-6 under section 437 and 439 of Cr.P.C., seeking to enlarge him on bail in SC.No. 475 of 2011 [Cr.No.87 of 2010 of Hussainialam Police Station, Hyderabad] on the file of the Court of XIV Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, for the offences punishable under section 302, 120-B, 122, 123, 124-A, 153-A read with section 34 of IPC section 16, 18 and 20 of Unlawful Activities [Prevention] Act, 1967 and section 25 and 27 of Arms Act.

2. Heard the learned counsel appearing on behalf of the petitioner/A-6 and the learned Additional Public Prosecutor appearing on behalf of the State.

3. Pursuant to order dated 07/11/2016 the medical report is submitted whereby it is stated that the petitioner is suffering from "recurrent annal fissure" since two years, known IMH patient, vide

patient I.D.No. 15068, dated 22/6/2011, pain in the right shoulder. It is further stated that at present he is taking treatment for "recurrent annal fissure" at Osmania General Hospital, Hyderabad and at Government Unani Hospital, Charminar, Hyderabad, periodic basis.

4. Thus, the petitioner/A-6 is getting proper treatment from Chenchalguda Jail, Hyderabad, itself in the hospitals mentioned above. There are thirty five prosecution witnesses in the above SC.No. 475 of 2011, twenty five prosecution witnesses have already been examined and two prosecution witnesses have been called for examination today as stated by the learned Additional Public Prosecutor. In addition to that, the trial court was directed to fix the trial schedule on day-to-day basis and conclude the matter expeditiously.

5. Since the offence is serious against the petitioner/A-6, I find no ground to admit the petitioner/A-6 on bail and the petition is accordingly dismissed.

6. I hereby make it clear that the trial court; namely, XIV Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, is directed to fix the trial schedule on day-to-day basis and conclude the matter as expeditiously as possible, preferably within two months, from the date of receipt of a copy of this order.

7. As a sequel, miscellaneous petitions if any pending in this Criminal Petition shall stand disposed of.
