IN THE HIGH COURT OF JUDICATURE AT HYDERABAD

FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) MONDAY, THE THIRTEENTH DAY OF JULY TWO THOUSAND AND FIFTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.19763 OF 2015 BETWEEN Mohammad Yusuf ... PETITIONER AND The State of Andhra Pradesh, rep. by its Principal Secretary (Revenue Department) and others ...RESPONDENTS The Court made the following:

ORDER: - Heard.

2. Against the order passed by the Revenue Divisional Officer (RDO) in ROC.No.1847 of 2010 dated 21.01.2013 cancelling the pattadar passbook and title deed, petitioner has preferred a revision on 16.03.2013 before the District Collector, West Godavari District. Petitioner relies upon an acknowledgment dated 16.03.2013 from the Collectorate, Eluru, and submits that the said revision is pending and it might have been made over to the Joint Collector, Eluru. The grievance of the petitioner is that the said appeal is

neither been numbered nor taken up for hearing and particularly the interim application in the said revision petition is also not considered.

3. On the last occasion, this writ petition was adjourned to enable the learned government pleader to get instructions. It is now reported by the learned Assistant Government Pleader that the petitioner's revision is pending before the Joint Collector and he states that it would be heard and disposed of expeditiously.

4. In the circumstances, therefore, this writ petition is disposed of directing the Joint Collector, Eluru, to consider petitioner's revision along with the interim application for stay by fixing an early date and pass appropriate orders at least to the extent of interim application. The Joint Collector is also at liberty to fix a date for hearing of the revision after notice to both sides and then hear and dispose of the revision also expeditiously preferably within three months from the date of receipt of a copy of this order. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
