Gundapu Srihari Rao, S/O, Late Manikyala Rao, v. State Of Andhra Pradesh, Rep.By Its Special Chief Secretary
HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.27677 OF 2017 ORDER:
This writ petition is filed challenging the land acquisition Notifications dated 10.01.2017 and 17.01.2017 and the consequential publication of declaration dated 20.07.2017.
Learned counsel for the petitioners submits that the objections filed by the petitioners under Section 15(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act 30 of 2013, for brevity) are not considered properly by the Authorities. This Court, by an order dated 30.08.2017, in a batch of writ petitions, i.e., W.P.No.7016 of 2017 and batch, which are identical to the present writ petition, partly allowed the writ petitions setting aside the declarations published under Section 19(1) of Act 30 of 2013 and giving liberty to the petitioners to raise objections under Section 15(2) of Act 30 of 2013. In view of the same, this writ petition is also partly allowed setting aside the declaration dated 20.07.2017 in respect of the lands of the petitioners herein.
The petitioners are given liberty to file comprehensive written objections either individually or for the entire village in accordance with Section 15(2) of Act 30 of 2013, within two weeks from the date of receipt of a copy of this order and the Collector shall consider the said objections and deal with said objections thoroughly and pass a reasoned order considering the objections raised by the petitioners within a period of four weeks thereafter. It is needless to observe that at the time of considering the objections, the objectors shall be heard either in person or through their counsel. Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. __________________________ A.RAMALINGESWARA RAO, J 13.09.
