HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.373 of 2015 O R D E R:

This revision is filed by the petitioner-accused against the order dated 9.2.2015 passed by the Additional Assistant Sessions Judge, Karimnagar, in Crl.M.P.No.69 of 2014 in S.C.No.476 of 2014.

It is alleged that the petitioner-accused committed the offence punishable under Sections 354 and 506 IPC. The petitioner-accused filed the above Crl.M.P.No.69 of 2014 under Section 227 Cr.P.C. seeking to discharge him on the ground that there are no specific overt acts against him and he was falsely implicated. The learned trial Judge dismissed the said application. Hence, the present revision is filed.

After arguing for some time, the learned Counsel for the petitioner did not insist for grant of the relief prayed in this petition. But he prayed to dispense with the presence of the petitioner-accused before the trial Court. In view of the said submission, this Court is not inclined to interfere with the order under revision. Since the petitioner and the de facto complainant are known to each other, the question of identity does not arise. Considering these circumstances, the presence of the petitioner before the trial Court is dispensed with, except on the dates when the trial Court insists for his presence. Accordingly, the Criminal Revision Case is disposed of.
