Order:

This Writ Petition is filed for a Mandamus to declare the action of the respondents, in rejecting the petitioner's application for allotment of Plot No.18 at Cherlapally Phase-III, by proceeding in Lr.No.APPIIC/MOULA ALI/2011/770, dated 20.10.2011, and issuing the proceeding in

Lr.No.APIIC/MOULA ALI/2011/1194, dated 17-032012, requiring the petitioner to make a fresh application through online, as illegal and arbitrary. At the hearing, Mrs.Sujatha Kurapati, learned Counsel representing Mr.K.V.Bhanu Prasad, learned Counsel for the petitioner, submitted that the petitioner- Company has recently come to know through the information received under the Right to Information Act, 2005, that the plot claimed by it was provisionally allotted to a third party.

In view of this subsequent event, the Writ Petition as filed has become infructuous and the same is, accordingly, dismissed, however, with liberty to the petitioner to avail a fresh remedy by including the prayer for setting aside the provisional allotment.

As a sequel to dismissal of the Writ Petition, WPMP.No.35664 of 2012, filed by the petitioner for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 22nd July, 2015 LUR
