This petition is filed, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C.'), seeking for grant of anticipatory bail to the petitioner-accused in Crime No. 12 of 2018 of A.S. Pet Police Station, SPSR Nellore District, registered for the offences punishable under Sections 354 (a) and 354 (ii) IPC and Sections 3 (1) (r) and 3 (1) (w) (ii) of SC ST OPA Act. 2.

Heard learned counsel for the petitioner and learned Public Prosecutor (A.P.).

The case of the prosecution is that the petitioner used to harass the de facto complainant, who is a Sarpanch, and that he used to call her. The complaint also shows that the words of the petitioner were recorded. Learned Public Prosecutor submits that investigation is still in progress and that 164 Cr.P.C. statement of the de facto complainant is also proposed to be recorded.

Hence, considering the above, this Court is not inclined to grant anticipatory bail to the petitioner. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the Court below having jurisdiction. The Court below shall dispose of the bail application, if any filed, on merits expeditiously, preferably on the same day, subject to pressure of other work.

Subject to the above, the criminal petition is dismissed. Pending miscellaneous petitions if any shall stand dismissed in consequence.
