HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.10079 of 2010 ORDER:

Heard learned counsel for the petitioner/ accused and also learned public prosecutor representing the respondents of Crime No.107 of 2010 of Kadiri Town Police Station, registered for the offences punishable under Sections 408, 420, 468 and 477 IPC and perused the grounds urged in the quash petition and the contents of FIR and the interim stay of all further proceedings granted on 08.10.2010, which has been continued from time to time and is still in force.

2) In fact, a perusal of the material no way enables this Court to interdict the investigation.

3) Having regard to the above, the Criminal Petition is disposed of, vacating the interim stay dated 08.10.2010 for nothing to continue in this Criminal Petition but for all the remedies are left open on completion of investigation including placing of any material available with the petitioner before the Investigating Officer as part of investigation to consider. Needless to say, the petitioner shall not be arrested pending investigation but for to secure his presence as and when required for the purpose of investigation.

4) Pending miscellaneous petitions, if any, shall stand closed.
