HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY Writ Petition No. 19830 of 2012 ORDER :

This writ petition is filed seeking writ of mandamus declaring the action of the respondents in not taking any steps to stop the brick-kilu unit started by the 4th respondent in Sy.Nos.31/6-B and 32/2-A of Ippanapadu village, Mandapeta Mandal, E.G.District in terms of the guidelines under G.O.Ms.No.80, dated 22.04.2010 as illegal and arbitrary.

Heard Sri T.V.S.Prabhakar Rao, learned counsel for the petitioner, Sri Ravi Cheemalapati, learned Standing Counsel for the 1st respondent and Sri S.Siva Bhami Reddy, learned counsel for the 4th respondent. Sri Ravi Cheemalapati, learned Standing Counsel for the 1st respondent submits that in pursuant to the complaint of the petitioner, they warned the 4th respondent.

Learned counsel for the 4th respondent submits that 4th respondent is not manufacturing any bricks in her land, as alleged by the petitioner.

Recording the statement made by the learned counsel for the 4th respondent, this writ petition is closed. However, it is open for the petitioner to challenge the action of the 4th respondent, in case she resorts to manufacturing of bricks in future. There shall be no order as to costs. As a sequel thereto, miscellaneous applications, if any pending in this Writ Petition, shall stand dismissed.
