HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.3261 of 2015 ORDER:
This revision is preferred challenging the order dated 28-09-2015 made in Calendar Case No.280 of 2015 on the file of the Special Magistrate, Amalapuram, East Godavari District, wherein the learned Magistrate issued N.B.W. against the petitioner No.1 - accused No.1.
The learned counsel for petitioners - accused Nos.1 and 2 submitted before this Court that petitioner No.1 - accused No.1 is ready to face the trial and she will not flee from the hands of justice. Having heard the learned counsel for the petitioners and the learned Public Prosecutor and having perused the material available on record, this Court is of the view that the revision can be disposed of with the following directions :
The petitioner No.1 - accused No.1 is directed to surrender before the Court concerned and file a petition to recall the warrants issued against her and on such filing of a petition, the trial Court is directed to recall the warrants on the same day on her execution of a bond for a sum of Rs.5,000/- (Rupees Five thousand only) with one surety for a like sum and further the petitioner No.1 - accused No.1 is directed to appear before the trial Court regularly. Accordingly, the Criminal Revision Case is disposed of. Consequently, the Miscellaneous Petitions pending, if any, in this revision shall stand closed.
