HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.5051 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/Accused Nos.2 to 10 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.75 of 2015 of Narketpally Police Station, Nalgonda District registered for the offences punishable under Sections 420, 498-A, 307, 323, 354, 506 I.P.C and Sections 3 and 4 of the Dowry Prohibition Act.

2) Heard the learned counsel for the petitioners and the 1st respondent-State represented by the Public Prosecutor before admission and before ordering notice to the 2nd respondent and perused the material on record.

3) As the material falls short to admit the application under Section 482 Cr.P.C to quash the crime proceedings, the same is disposed of with a direction to the police not to arrest pending investigation of any of these petitioners and in the event of final report being filed by showing any complicity by mentioning the fact, the final report to be filed and the learned Magistrate to issue summons for their appearance. Any other remedy, if any, is left open to the petitioners.

4) With the above observations, the Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, in this criminal petition shall stand closed.
