This criminal petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/A.4 seeking his enlargement on bail in connection with FIR No.168 of 2023 of INSP Admin (DD) Police Station, Hyderabad. The offences alleged against the petitioner are under Sections 406 and 420 r/w. 34 of IPC and Section 5 of TSPDFE Act.

The case of the prosecution is that on 18.05.2023 the defacto complainant lodged a report before Police, wherein it is stated that he along with 28 others have invested an amount of Rs.3,71,80,000/- in V.V. Enterprises at the instance of one Mr.Mohammed Shareef. Initially they received interest and thereafter there is no such payment made by the said company. On payment, they also issued multiple cheques towards security for the invested capital. They have provided the returns for few months from the date of investment and later on discontinued to give returns and started behaving in a strange manner. When they tried to deposit the cheques they were returned with an endorsement 'in-sufficient funds' and requested the police for taking necessary action, basing on the same, Police registered the case against the accused for the above offences.

Heard Sri Seshagiri Rao Ylamanchili, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State.

The contention of learned counsel for the petitioner is that petitioner is no way connected with V.V. Enterprises and no

- 3 - such amount was deposited with the petitioner herein. Even according to the defacto complainant basing on the MOU between V.V. Enterprises and M/s.Shri Guru Datta Enterprises petitioner herein is made as A-4 and there is no direct contact between petitioner and the defacto complainant. Petitioner is in jail since 13.02.2026. Though there are 4 more cases according to the prosecution, they are registered by the different firms in view of the same cause of action. The entire investigation is completed. As such, his custodial interrogation is not required anymore. The petitioner undertakes to abide by any conditions that may be imposed by this Court. Hence, prayed this Court to grant regular bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the there is a serious financial fraud, huge amounts are involved and number of victims are there and investigation is not yet completed. The petitioner are not entitled for bail and prayed to dismiss this petition. 6.

Considering the submissions made and the material on record, petitioner is in jail from 13.02.2026. As seen from the record there is no such agreement between the petitioner and the defacto complainant and in other cases also petitioner is

- 4 - already granted bail. Considering the period of incarceration of petitioner in jail, this Court deems it appropriate to grant regular bail to the petitioner subject to the following conditions: i. The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the Metropolitan Sessions Judge, Hyderabad.

ii. The petitioner shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. The petitioner shall abide by the conditions stipulated in Section 483(2) of the BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
