Chukkapalli Aruna Kumar v. The Guntur Municipal Corporation,
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.29464 OF 2011
O R D E R
The grievance of the petitioners is that though the lease period is existing till 31.03.2012, even before the completion of the lease period, the respondent authorities are trying to evict the petitioners. Aggrieved by the same, the present writ petition is filed.
In the interim order granted on 28.11.2011, it is made clear that the petitioners shall vacate the premises in question only after expiry of the lease period. Admittedly, the lease is expired by 31.03.2012. It is also stated that writ appeal No.103 of 2012 was filed challenging the interim orders, but the same was dismissed.
Heard both sides.
Since in the interim order dated 28.11.2011, it is clearly stated that petitioners have to vacate the premises in question after the expiry of the lease period i.e, 31.03.2012, the cause in the writ petition no longer survives for adjudication. Hence, the writ petition is dismissed as infructuous. There shall be no order as to costs. As a sequel, miscellaneous petitions pending if any, shall stand closed.
