THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5071 of 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in crime No.5 of 2016 on the file of the Tirupati East Police Station, Tirupati, Chittoor District, registered for the offence under Sections 420, 506, 120-B IPC read with Section 34 IPC and Section 5 of the A.P.Protection of Depositors of Financial Establishments Act.

Heard and perused the material.

Learned counsel for the petitioner submits that A.1 and A.3 in the present case were already arrested and were released on bail. He further submits that even though the present petitioner/A.2 is the Chief Managing Director and is resident of Vijayawada, he is not at all concerned with the affairs of the Tirupati Branch directly and as such, prays this Court to quash the proceedings.

Considering the facts and circumstances of the case and also considering the submission of the learned counsel for the petitioner, the police are directed to complete the investigation without arresting the petitioner herein and file final report, if any, in accordance with law. The police are directed to issue notice to the petitioner for his appearance for the purpose of investigation and the petitioner is directed to appear and cooperate with the investigating agency. The petitioner is also directed to submit an Undertaking for his future appearance for the purpose of investigation.

The Criminal Petition is accordingly disposed of. Miscellaneous Petitions pending in this Criminal Petition, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 11.04.2016 pln
