This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the inaction of respondent Nos.2 to 4 in considering the representation, dated 28.01.2019, of the petitioners, not to appoint respondent Nos.7 to 11 as Members of the Persons-in-charge Committee of respondent No.5/ Society, as illegal and arbitrary and consequently, to direct respondent Nos.2 to 4 to take action on the representation, dated 28.01.2019, of the petitioners.

Heard learned counsel for the petitioners and the learned Government Pleader for Co-operation, appearing for respondent Nos.1 to 4, and perused the record.

Learned counsel for the petitioners would contend that on expiry of the term of Co-operative Societies in terms of G.O.Ms.No.12, Agriculture and Cooperation (Coop.II) Department, dated 31.01.2018, the Persons-in-charge Committees are being appointed to the Co-operative Societies. Though there are several allegations of malfunctioning against respondent Nos.7 to 11, they are being appointed as members of Persons-in-charge Committee of respondent No.5/ Society. Bringing the same to the notice of the authorities concerned, a representation, dated 28.01.2019, is made by the petitioners. However, no action is taken yet on the said representation. Hence, the present Writ Petition is filed.

As per the record, there is no much dispute with regard to the petitioners filing representation, dated 28.01.2019, to take action against respondent Nos.7 to 11. Learned Government Pleader for Co-operation brought to the notice of this Court certain information with regard to filing of Writ Petitions by the parties concerned and the results thereof. It is not necessary to go into the merits and out come of the orders passed in the said Writ Petitions.
Since no action is taken yet on the representation, dated 28.01.2019, of the petitioners, a direction can be given to respondent Nos.2 to 4 to examine and dispose of the said representation, as expeditiously as possible. 5 .
Under these circumstances, respondent Nos.2 to 4 are directed to examine and dispose of the representation, dated 28.01.2019, of the petitioners, as expeditiously as possible, preferably within a period of three (3) months from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. ______________________ Dr . SHAMEEM AKTHER, J April 25, 2019.
