THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.24175 OF 2014 ORDER:

This writ petition is filed challenging the action of the respondents in not considering the representation dated 17.04.2014 of the petitioner in respect of the land of the petitioner situated in survey No.769/C of Sircilla Town, Rajanna Sircilla District.

It is the case of the petitioner that earlier he filed W.P.No.15532 of 2013, wherein a counter affidavit is filed by the Tahsildar, Sircilla, undertaking not to change the revenue records and maintain status quo. Enclosing the copies of the counter affidavit filed in the said writ petition, the petitioner sought for protection to the said land. When the said representation is not considered, the present writ petition is filed. It appears that the petitioner has not initiated any civil proceedings against the persons who are trying to encroach his land. The police can interfere only when there is a clear order from the competent civil Court with respect to the land, as otherwise it would amount to interference of the police in civil disputes.

In the circumstances, this writ petition is disposed of giving liberty to the petitioner to take appropriate civil proceedings against the persons who are trying to trespass into his lands or to lodge a complaint to the Station House Officer, the third respondent herein, in case any offence takes place.

The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 27.03.2017 pln
