HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15758 OF 2017 ORDER:
The case of the petitioner is that he was assigned agricultural land admeasuring Ac.3-10 guntas in Sy.No.27/2, situated at Manneguda Village, Hayathnagar Mandal, R.R.District and issued patta certificate in accordance with G.O.Ms.No.1406 dated 26.07.1958 and G.O.Ms.No.1724 dated 26.03.1959. Petitioner was also issued pattadar passbook in the year 1978. Thereafter, petitioner made several representations to the 2nd respondent seeking incorporation of his name in the pahanies and ultimately he made the latest representation on 12.05.2015. As no action has been taken, the present writ petition is filed. Heard the learned counsel for the petitionr.
Learned Assistant Government Pleader for Revenue on instructions submits that in respect of same survey number which the petitioner is claiming, pattas have been granted to different persons, as such the question of considering the representation of the petitioner does not arise.
In view of the above facts and circumstances, since the representation of the petitioner is stated to be pending before the 2nd respondent, it is for the 2nd respondent to consider the representation of the petitioner by taking the above factors into account and after issuing notice and affording an opportunity of hearing to the petitioner.
In view of the above, without expressing any opinion on merits, the 2nd respondent is directed to dispose of the representation of the petitioner in accordance with law.
With the above direction, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 27.04.2017 dv
