THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.10463 OF 2016 ORDER:

The petitioner joined the services of the respondents corporation as conductor on 23-06-1986 after undergoing the process of selection. Subsequently, his services were regularized w.e.f. 15-07-1987. Thereafter, he was promoted as ADC/Controller on 20-01-2013. While so, a charge sheet was issued on 30-10-1997 alleging that he was involved in some ticket irregularities case while conducting the bus service on 31-05-1997. He submitted his explanation on 20-04-1998. But, without conducting enquiry, an order was passed imposing punishment deferring annual increments for a period of two years, vide order, dated 07-081998. Against the said order, the petitioner preferred an appeal to the 2nd respondent on 10-09-2004. When the said appeal was not disposed of in spite of notice through his counsel on 22-12-2015, the present writ petition is filed.

2. In view of pendency of appeal before the 2nd respondent, this Court is not inclined to go into the merits of the case. Therefore, the 2nd respondent is directed to consider the appeal preferred by the petitioner on 10-09-2004 and pass appropriate orders thereon in accordance with law within a period of three months from the date of receipt of a copy of this order.

3. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
