THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43582 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to call for the records and quash the FIR No.175 of 2016.
Heard and perused the material available on record. The case of the petitioners is that the 5th respondent lodged a private complaint before the Judicial Magistrate of First Class, at Madhira, Khammam District, which was referred to the 4th respondent, who registered the same as FIR No.175 of 2016, alleging that the 5th respondent, who is the absolute owner and possessor of dry land admeasuring Ac. 2.20 guntas, situated in Survey No.172/E/1, Meenavolu Revenue Village of Yerrupalem Mandal, Khammam District and when he applied to the petitioners, who are Tahsildar and Revenue Inspector in Yerrupalem Mandal Revenue Office, Khammam District, for issuing pattadar pass book and title deeds, the 5th respondent came to know through RTI Act vide R.C.No.C/737/2016, dated 11.04.
2016, that the petitioners issued the pattadar passbook and title deeds to the 5th respondent, which are not original. The main grievance of the petitioners is that the 5th respondent has foisted a false case against the petitioners and that the petitioners are apprehending arrest in the hands of the 4th respondent at the instigation of the 5th respondent.
Considering the grievance of the petitioners, the 4th respondent is directed to complete the investigation in FIR No.175 of 2016 as expeditiously as possible and file a final report, if any,
either way in accordance with law, without arresting the petitioners.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
