HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 7444 of 2018 ORDER:

The inaction of respondent No.2 - District Collector, Machilipatnam, Krishna District, in taking action pursuant to report of respondent No.4 dated 02.02.2017, is complained of in the present Writ Petition.

Petitioner states that respondent No.6, being Sarpanch of Salempalem Gram Panchayat, was involved in various omissions and commissions, particularly financial irregularities. On enquiry being ordered by respondent No.2, respondent No.4 submitted a detailed report stating that an amount of Rs.26,88,813/- was misappropriated under different heads between 01.08.2013 and 28.07.2016; and to take action for recovery of the amount from the persons concerned. Petitioner's grievance is that, despite his representation dated 23.10.2017 to respondent No.2 sensitizing misappropriation in the Salempalem Gram Panchayat, respondent No.2 had not acted on the same. Hence the Writ Petition.

Both Sri Golla Seshadri, learned Standing Counsel for the respondent No.5 - Gram Panchayat, and learned Government Pleader for Revenue seek time to get instructions.

Having regard to the limited grievance that the petitioner espouses in the writ petition, this Court is of the opinion that, no useful purpose would be served keeping the writ petition pending and, it would suffice, if respondent No.2 is directed to consider and dispose of the representation of the petitioner dated 23.10.2017, considering the report of respondent No.4 dated 02.02.2017, as expediently as possible, at any rate, within a period of eight weeks from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. Consequently, miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs. ____________________________ CHALLA KODANDA RAM,J Date: 13.03.2018 usd
