The petitioner is challenging the endorsement of the 3rd respondent dated 17-01-2017, whereby the 3rd respondent rejected the application of the petitioner for grant of transit permits for transportation of wind fallen/broken/damaged tree materials in Hud Hud cyclone on the ground that he has no power to grant the same beyond 31-03-2016.

Learned counsel for the petitioner submits that the petitioner also made representation to the 2nd respondent for grant of transit permits, but the 3rd respondent has rejected the application.

Learned Government Pleader for Forest submits that only District Collector has power to grant transit permits under the rules. But during Hud Hud cyclone, said power was obligated to the 3rd respondent, which was valid only till 31-03-2016.

In view of the same, the 3rd respondent has rightly rejected the application of the petitioner. Learned counsel for the petitioner could not dispute the assertion made by the learned Government Pleader for Forest. Hence, I do not see any error in the impugned order. Further, since it is stated that the petitioner made such representation to the

2nd respondent, the 2nd respondent shall consider the same and pass orders, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. Accordingly, this writ petition is disposed of.
