HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.8993 of 2019 ORDER:

The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue writ or direction more particularly one in the nature of writ of Mandamus declaring the memo No B/2449/2018 dt 10.1.2019 issued by the 3rd respondent is illegal arbitrary unconstitutional and also violation of the Articles 14, 16 and 19 (1) g the said memo No B/2449/2018 dt 10.1.2019 may be set aside and to issue the consequential direction to the respondents to consider the application for issuance of new pattedar pass books and title deeds in place of existing/old pattedar pass books and title deeds to the petitioners in respect of the land an extent Ac 3 35 1/2 guntas Sy No 151/7A Ac. 0-07 1/2 Sy No.226/A Ac.

3-28 gts situated at Sabashpally Village Shivampet Mandal Medak District and further direct the respondents to extend the benefits under the Rythu Bandhu Scheme in terms of the G.O.Rt.No.231 dt 4.4.2018 and pass such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case." Sri T. Sudhakar Reddy, learned counsel for the petitioner, would inform this Court that the issue that arises for consideration in this Writ Petition was already considered by this Court in W.P.No.3692 of 2019 and batch. A copy of the common order dated 15.3.2019 passed in W.P.No.3692 of 2019 and batch is placed on record. The learned Assistant Government Pleader for Revenue, State of Telangana, fairly concedes that the aforestated order would cover this case also.

In that view of the matter, for reasons alike as were mentioned in the aforestated common order and in terms thereof, this Writ Petition is disposed of directing the Tahsildar, Shivampet Mandal, Medak District, to reconsider the application of the petitioner for issuance of new pattadar pass books in relation to her land covered by the existing pattadar pass books without reference to the status-quo order dated 23.01.2017 passed in W.A.No.1432 of 2016. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.

Miscellaneous Petitions pending in this Writ Petition shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date: 4th June, 2019.
