Dandu Manohar S/O. Late D.Ramaswamy v. The State Of Andhra Pradesh Dept. Of Revenue, Secretariat
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.14536 OF 2017 ORDER:
This writ petition is filed declaring the action of the 4th respondent in trying to mutate the name of the 5th respondent in revenue records in respect of the land admeasuring Ac.4.98 cents in Sy.No.247-3 of Udiripikonda Village, Kudair Mandal, pending adjudication of Revision petition filed by the petitioner before the 2nd respondent against the impugned order dated 18.01.2017 passed by the 4th respondent vide Rc.No.156/A/2017, as illegal and arbitrary.
Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Revenue submits that unless petitioner avails the remedy of appeal, he cannot straight away file Revision against the order dated 18.01.2017 passed by the 4th respondent.
Learned counsel for the petitioner also does not dispute that Appeal lies against the order passed by the 4th respondent on 18.01.2017.
In view of the same, it is open for the petitioner to avail alternate remedy of appeal against the order of 4th respondent before Revenue Divisional Officer (RDO). Status-quo shall be maintained for a period of two (2) weeks from today enabling the petitioner to avail the appellate remedy.
With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 21.04.2017 dv
