THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9619 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-accused No.11, under Section 438 of the Criminal Procedure Code, seeking anticipatory bail in Crime No.75 of 2016 on the file of Mannur Police Station, YSR Kadapa District, registered for the offences punishable under Sections 147, 148, 353, 307, 379, 120(B), 109 R/w.149 IPC, 20(1)(C) (ii)(iii)(iv)(vi)(x) and 29 (2)(b)(4)(a)(i)(ii)(b) of AP Forest Act and 3 of AP Sandal Wood & ed Sanders Wood Transit Rules, and 3 of PDPP Act and Section 51 of Wild Life Protection Act. The allegations against the petitioner are that he along with the other accused was found transporting the red Sandal Wood logs illegally and when the police personnel tried to apprehend them, they attacked the police.

Heard and perused the material available on record. Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged offences and he was falsely implicated in this case.

Learned Additional Public Prosecutor submitted that the petitioner is involved in other cases of similar nature and hence, he is not entitled for anticipatory bail.

In view of the submission of the learned Additional Public Prosecutor, this Court is not inclined to grant anticipatory bail to the petitioner.

Hence, the Criminal Petition is dismissed.
