Order:

This Writ Petition is filed for a Mandamus to set aside Order, dated 16-07-2012, passed by respondent No.2, in File No.37/DW/GM (QC)/MW/2010-11/1347/D/569/D, whereby the products viz., HIV Rapid Diagnostic Test Kits

B.No.GHV 0411 & B.No.BHV 0511, manufactured and supplied by the petitioner, were black listed for a period of three years from the date of the said order. At the hearing, Mr.Ramakanth Reddy, learned Counsel representing Dr.Venkata Reddy Donthi Reddy, learned Counsel for the petitioner, submitted that as the period of three years, in respect of which the impugned order of black listing was passed, has expired, no further adjudication of the Writ Petition is necessary.

He has, however, submitted that in pursuance of interim order, dated 26-12-2012, passed by this Court in the Writ Petition, the Superintendent, Osmania General Hospital, has submitted his report, dated 23-02-2013, on the quality of the said kits manufactured and supplied by the petitioner and that the Registry be directed to furnish a copy of the said report to him to enable his client to take appropriate action.

The request of the learned Counsel for the petitioner is accepted and the Registry is directed to furnish a copy of the report, dated 23-02-2013, of the Superintendent, Osmania General Hospital, to the learned Counsel for the petitioner on the latter approaching it.

Subject to the above direction, the Writ Petition is disposed of as infructuous.

As a sequel to disposal of the Writ Petition, WPMP.Nos.36839 and 46651 of 2012, filed by the petitioner for interim reliefs, are disposed of as infructuous.
