THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CRIMINAL PETITION No.3004 of 2017 ORDER:

The present petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Code'), requesting to quash the First Information Report in Crime No.5 of 2017 of Nindra Police Station, Chittoor District.

The petitioner is arraigned as accused No.1 and alleged to have committed the offences punishable under Section 498-A read with 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act. Heard Sri Suresh Kumar Reddy Kalava, learned counsel for the petitioner, and the learned Additional Public Prosecutor for the State of Andhra Pradesh.

Learned counsel for the petitioner, having made a few submissions, however, confines the request to the extent of giving a direction to the Investigating Officer to adhere to the procedure under Section 41A of the Code.

The request of the learned counsel for the petitioner can be accepted and, therefore, acceded to. The Investigating Officer is directed to follow the procedure under Section 41-A of the Code and also the guidelines laid down by the Hon'ble Supreme Court in Arnesh Kumar v. State of Bihar1.

With the above direction, the Criminal Petition is dismissed at the stage of admission itself.
