THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.2347 of 2022 ORDER:

This Criminal Petition, under Section 439 read with Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A.1, seeking to reduce the surety amount imposed in the order dated 22.02.2022 passed in Crl.M.P.No.236 of 2022 in C.C.No.23 of 2018 by the XXI Additional Chief Metropolitan Magistrate-cum-Special Judicial Magistrate of First Class for Trial of CBI Cases, at Hyderabad. 2.

Heard the learned counsel for petitioner/A.1, learned Special Public Prosecutor for CBI and perused the record. 3.

The learned counsel for the petitioner/A.1 would submit that petitioner/A.1 was granted bail vide order dated 22.02.2022 passed in Crl.M.P.No.236 of 2022 in C.C.No.23 of 2018 by the XXI Additional Chief Metropolitan Magistrate-cum-Special Judicial Magistrate of First Class for Trial of CBI Cases, at Hyderabad, on the condition of petitioner/A.1 executing personal bond for Rs.1,00,000/- with two(2) sureties and that he shall not leave the country without prior permission of the Court. However, since the petitioner/A.1 is in judicial custody and as all his accounts are frozen by investigating agencies, he has no financial capacity to execute personal bond for a sum of

Rs.1,00,000/- with two(2) sureties and hence, the surety amount imposed in the aforesaid order dated 22.02.2022 may be reduced. 4.

Under these circumstances, the condition imposed in the order dated 22.02.2022 passed in Crl.M.P.No.236 of 2022 in C.C.No.23 of 2018 by the XXI Additional Chief Metropolitan Magistrate-cum-Special Judicial Magistrate of First Class for Trial of CBI Cases, at Hyderabad, directing the petitioner/A.1 to execute personal bond for Rs.1,00,000/- with two sureties is modified and ordered as follows: "The petitioner/A.1 is enlarged on bail on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two(2) sureties."

The other condition imposed in the order dated 22.02.2022 passed by the Court below, remains unaltered. 6.

Accordingly, this Criminal Petition is ordered. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
