HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No. 9012 of 2019 ORDER:

1) The grievance of the petitioner in this Writ Petition is that respondents 2 to 4 are not restoring the power supply to the petitioner's Service Connection No. 442111005021948 despite the petitioner expressing his readiness to pay the amounts as assessed in the provisional assessment order dated 02.04.2019.

2) Mr.Jalala Ali, learned Standing Counsel appearing for respondents 2 to 4 would submit that insofar as the payment of amounts in the form of penalty is concerned, it does not pertain to the cause of action in the present writ petition. Regarding restoration of power supply is concerned, he submits that the 5th respondent has filed his objections before the respondents 2 to 4 indicating that the 5th respondent is the owner of the premises and he has objected in restoring the power supply. In this regard, respondents 2 to 4 have informed the petitioner to file proof of documents in support of his claim as contemplated in the guidelines of the Electricity Board.

3) Without going into the merits of the case, the Writ Petition is disposed of giving liberty to the petitioner to

approach the respondents 2 to 4 along with all the required documents as contemplated under the Electricity Act and Rules, in which event, respondents 2 to 4 shall decide the matter and communicate the same to the petitioner within a period of two working days.

4) Consequently, miscellaneous petitions if any pending in this writ petition shall stand closed. No order as to costs. __________________ T. AMARNATH GOUD, J 26.04.2019 gkv
