ORDER:

This Civil Miscellaneous Appeal arises out of order dated 24-2-2005 in I.A.No.632 of 2003 in O.S.No.117 of 2003 on the file of the learned Senior Civil Judge, Gudur, Nellore District.

At the hearing, there is no representation for the parties.

I have perused the record.

The appellant has filed the above mentioned suit for a preliminary decree against the respondents for a sum of Rs.4,31,380/- against respondent No.1 based on a mortgage. In the said suit, the appellant has filed I.A.No.632 of 2003 for temporary injunction restraining respondent No.2 from alienating the plaint schedule property. By order dated 24-2-2005, the lower Court dismissed the said application. In the present Civil Miscellaneous Appeal, the appellant has filed CMAMP No.654 of 2005 for injunction. This Court, by reasoned order dated 27-4-2005 has granted injunction as prayed for. As the injunction is subsisting for nearly ten years, it is appropriate that the same is continued till disposal of the suit. The Civil Miscellaneous Appeal is

accordingly dismissed. As the suit is of the year 2003, the lower Court is directed to dispose of the same, if not already done, within six months from the date of receipt of this order.
