HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.13502 of 2017 ORDER:

Heard Mr.N.Srinivas Yadav for petitioners and the learned Assistant Government Pleader for Revenue.

The petitioners pray for the following relief :- " ..... to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus to declare the action of the respondents in not granting assignment pattas for an extent of 3 acres of Agriculture Lands to the petitioners at Koppunur Village Chinnambavi Mandal, Wanaparthy District and to declare the same as illegal, arbitrary and violative of Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondents to grant assignment pattas for an extent of 3 acres of Agriculture Lands to the petitioners as per the eligibility in Koppunur Village, Chinnambavi Mandal Wanaparthy District....." . On 21.02.2017, the petitioners alleged to have represented to respondents for implementing the scheme of assignment in favour of petitioners under 'Land Purchase Scheme'. In spite of representation, the respondents are not moving in the matter. Hence, the writ petition.

The Assistant Government Pleader places on record written instructions dated 18.01.2018. The operative portion reads as follows :- " In this context it is to inform that, during Prajavani Programme, the SC community people of Koppunur Village, Chinnambavi Mandal have submitted application requesting to allot

3.00 acres to each SC women beneficiary under Land Purchase Scheme.

In this case, the Tahsildar, Chinnambavi Mandal has been directed to identify suitable agriculture lands for allotment to the beneficiaries under Land Purchase Scheme. The identification of agriculture land in Koppunur Village under progress. Soon after identification of agriculture lands, beneficiaries list will be finalized and all will be provided to the petitioners subject to eligibility." From the above, it is clear that the respondents are also on the job. However, due to a few practical difficulties they could not proc eed in finalizing the assignment under 'Land Purchase Scheme'.

Respondents 2 and 3 are directed to look into the representation filed by petitioners and also expeditiously consider the prayer and grant assignment to eligible persons. The writ petition is disposed of accordingly. No order as to costs.
