Shaik Abdul Nabi S/O Rana Hussain v. The State Of Andhra Pradesh
THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 27675 of 2015 ORDER:
This writ petition is filed challenging the action of the respondents in not paying an amount of Rs.1 lakh to the 1st petitioner and not releasing the seized stocks of 119.50 Quintals of rice to the petitioners 2 and 3 pursuant to the orders passed by the learned District Judge in ECP Appeal No.66 of 2012 dated 31.05.2013. The learned Government Pleader submitted before this Court a copy of the written instructions issued to him in respect of the above subject matter and it reads as follows;
" In the meanwhile, Sri Sk.Abdul Nabi, S/o.Rana Hussain, Driver cum owner of the lorry bearing No.AP 37U 2795, Achampeta Village, Guntur District and others have filed a WP.No.27675/2015 in the reference 7th cited with a request to direct the authorities concerned to release 100% value of the seized stock and release the bank guarantee filed by the owner of the lorry to the appellants at the time of release of the seized lorry, as per the orders of the Hon'ble District Judge in ECA No.66/2012, dated 31.05.2013. Accordingly, the Assistant Grain Purchasing Officer, Vijayawada was authorized to draw an amount of Rs.1,34,438/- covered by challan bearing No.12384, dated 24.02.2011 and refund the same to the owner of the seized stock Sri Samka Lakshminarayana, S/o.Sambasivannaramana, R/o.
Dodleru Village, Krosuru Mandal, Guntur District under proper acknowledgment vide this office ECP No.654/2010, dated 01.09.2015. The Bank guarantee bearing No.2010-11/005, dated 28.08.2010 of the Bank of India, Brodipet Branch, Guntur District for Rs.1,00,000/- filed by Sri Sk.Abdul Nabi at the time of release of the seized lorry returned to Sri Sk.Abdul Nabi, S/o.Rana Hussain, Driver cum owner of the lorry bearing No.AP 37 U 2795, Achampeta Village, Guntur District vide this office ECP No.654/2010, dated 01.09.2015."
The same is recorded and if anything remains with the respondents, the respondent shall comply with the order passed by the
learned District Judge in ECP No.66/2012, dated 31.05.2013, within a period of one month from the date of receipt of a copy of this order. Accordingly the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
