HONOURABLE SRI JUSTICE S.V.BHATT WRIT PETITION No. 12612 of 2015 ORDER:

The petitioners pray for Mandamus declaring the action of second respondent in refusing to receive, register and release the document alleged to have been presented by the petitioners in respect of tiled house vide Door No. 47-12, situated at West side of Gorle Street Municipal Road, Ward No.16, covered by

Sy.No.162/2 (part) of Salur Village, Salur Municipality, Vizianagaram District as illegal, arbitrary and without jurisdiction.

This Court, through order dated 06.03.2014 in Writ Petition No. 1339 of 2014 and batch, has considered legality of objection in refusing to register on the ground that the petitioner land is 'Gramakantam' and held that occupied 'Gramakantam' cannot be claimed as property belonging to Government and on such presumptuous approach include the property in the prohibited list. For the reasons recorded in Writ Petition No. 1339 of 2014 and batch, the Writ Petition is ordered.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence.
