HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43011 of 2016 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to quash the proceedings against them in Crime No.179 of 2016 on the file of the Kataram Police Station, Jayasankara District (Warangal).

Heard and perused the material available on record. 3.
The above crime was registered for the offences under Sections 323, 504, 506 r/w 34 IPC and Sections 3(ii)(va) of SCs & STs (POA) Amendment Act, 2015. It is alleged that the petitioners based the 6th respondent in the name of his caste and beat him at the belt shop, whereas it is the case of the petitioners that at the belt shop, there was an altercation, during the course of which, the 6th respondent pushed the 2nd petitioner, as a result of which, he sustained injury to his leg and that the 2nd petitioner lodged a complaint against the 6th respondent and a case in Crime No.178 of 2016 was also registered against the 6th respondent. As a counter-blast, the present complaint was lodged by the 6th respondent. 4.
The petitioners filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation in the above crime. However, taking into consideration the case and counter cases, the official respondents are directed to complete the investigation and file a final report, in accordance with law, without arresting the petitioners. The petitioners are directed to appear before the Station House Officer concerned as and when required and they are also directed to execute a personal bond for a sum of Rs.5,000/- (Rupees Five
Thousand only) with one surety each for the like sum each to the satisfaction of the Station House Officer concerned, as surety for their future appearance as and when required.
