THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.8019, 8918 and 8971 of 2015 COMMON ORDER:

All the petitioners are fair price shop dealers in Chilakaluripet Mandal in Guntur District. It appears that consequent to the inspection, certain variations were noticed in the stock and on the basis of the same, proceedings under Section 6A of the Essential Commodities Act were initiated against the petitioners and they are pending.

The above Writ Petitions were filed challenging the action of the fifth respondent in not supplying the stock from July, 2014 and November, 2014.

It is the case of the petitioners that their authorisation is in force and without suspending the same or taking any proceedings for cancellation, the stock was not supplied to the petitioners. It appeared from the record that the authorisation of the petitioners expired on 31.03.2015 and they applied for renewal later on. If the authorisation of the petitioners is in force as on today, they are entitled for supply of the stock.

In the circumstances, all the Writ Petitions are disposed of directing respondent Nos.4 and 5 to look into the record and if it is found that the authorisation of the petitioners is in force and valid as on today, necessary stock may be supplied to the petitioners. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
