HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 16599 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the orders passed by the 4th respondent dated 07.03.2003 denying approval to the appointments of the petitioners made by the 5th respondent as Junior Assistant and Record Assistant vide proceedings dated 14.03.1998 and 15.06.1999 respectively and issuing recruitment notification dated 11.06.2003 notifying the said posts, as illegal and arbitrary and consequently to declare that the appointments of the petitioners are deemed to be approved duly quashing the above orders with all consequential benefits. When the matter is taken up for hearing, learned counsel for the 5th respondent has submitted that the petitioners are not in service since 2003.

When the petitioners are not in service, the question of considering their case does not arise. Therefore, the writ petition is liable to be dismissed.

Accordingly, the writ petition is dismissed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
