JAISWAL Criminal Petition No. 1244 of 2011 Order: This Criminal Petition has been filed, under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C'), by the petitioner/accused requesting to quash the FIR in Crime No.84 of 2010 of Amrabad Police Station, Mahaboobnagar District, registered for the offences punishable under Sections 324, 504 and 506 IPC and Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

2. The facts would reveal that the de facto complainant is working as a driver under one Dasari Srinivasulu and that on 14.11.2010 at about 4.00 PM with the permission of his owner he went to the house of the petitioner/accused with Sumo vehicle and when the petitioner asked him to give the keys of the said vehicle he refused to give and on that pretext the petitioner abused him in an unparliamentary language touching his caste and beat him with a slipper by holding his collar. On the next day i.e., on 15.11.2010 at about 07.00 AM the petitioner came to the house of the de facto complainant and abused his brother namely Devender in filthy language by touching his caste and injured his left hand fingers with a stone and he also beat his father Sailu and making threatening calls and, thereby, committed the said offences. 3.

Heard both sides. 4. As seen from the facts occurring in the complaint, certainly, there is material, prima facie, sufficient to investigate into the offences levelled by the de facto complainant and nothing is forthcoming to cull out in inferring abuse of process of law as contended by the petitioner. 5. Having regard to the facts and circumstances of the case, the concerned police are directed to resort to the procedure contemplated under Section 41-A Cr.P.C., as per the decision of the Hon'ble Apex Court in Arnesh Kumar v. State of Bihar. 6. With the above direction, the Criminal Petition is disposed of. 7.
