HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos. 20484 of 2013; 24474, 24440 and 24443 of 2016 COMMON ORDER:

These four Writ Petitions are being disposed of by this common order as they were filed by the same petitioner. 2.

W.P.No.20484 of 2013 was filed challenging the action of the 1st respondent, Joint Commissioner of Labour, Warangal, in not referring the industrial dispute of the petitioner to the appropriate Court by holding that the dispute does not merit consideration for reference. W.P.No.24474 of 2016 was filed by the same petitioner seeking extension of benefit of wage revision to him from 22.10.1979 to 10.11.2001. Similarly, W.P.No.24440 of 2016 was filed for granting retiral benefits to the petitioner in the E-4 Grade from 22.10.1979 to 10.11.2001 and W.P.No.24443 of 2016 was filed challenging the action of the respondents in deducting an amount of Rs.46,250/- from the retirement benefits of the petitioner in the final settlement under MOS dated 10.11.2001.

A detailed counter-affidavit was filed by respondents 5 and 6. However, a perusal of the reliefs sought for in these writ petitions shows that the enquiry in respect of those issues involves verification of facts based on the record, which exercise cannot be taken by this Court in the proceedings under Article 226 of the Constitution of India. The appropriate remedy for the petitioner would be to approach the Labour Court.

In the circumstances, liberty is given to the petitioner to approach the Labour Court in accordance with law. It is open to the respective parties to raise their contentions, if the petitioner approaches the Labour Court.

All these Writ Petitions are accordingly disposed of. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
