THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.1853 OF 2016 ORDER:

The prayer of the petitioner is as under:

"For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleased to pass any order or direction more in the nature of a Writ of certiorari declaring the action of the 2nd respondent in trying to arrest the petitioner during the pendency of quash petition in CRLP No. 346 of 2016 filed by petitioner for quashing the FIR 850/2015 of Jubilee Hills Police Station pending before this Hon'ble Court and another petition filed by the petitioner seeking anticipatory bail in FIR 850/2015 in CRLP.No.585/2016 pending before the Hon'ble Court as arbitrary, illegal and even against to the fundamental rights of the petitioner and against the fundamental principles of natural justice and direct the 2nd respondent not to arrest the petitioner pending disposal of the above two petitions in the interest of equity and justice and pass such other order or orders may deem fit and proper in the circumstances of the case."

Admittedly, the petitioner has already filed a quash petition under Section 482 Cr.P.C. in Crl.P.No.346 of 2016 before this Court. He has also filed a petition seeking anticipatory bail in Crl.P.No.585 of 2016 before this Court. Having filed these two petitions, the petitioner now seeks the relief of staying his arrest pending disposal of the aforestated two petitions. It is not open to the petitioner to simultaneously prosecute so many cases on the same cause of action. The writ petition is therefore utterly misconceived and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
