HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 7499 of 2018 ORDER:

Petitioner challenges the impugned notification dated 17.02.2018 inviting applications from BC-D (General) for appointment of a permanent dealer in respect of fair price shop No.0856021, Pakala Village, Singarayakonda, on the ground that there are no BC-D group candidates available in the Village, and all the ration card holders belong to BC-A group only; the petitioner, who is continuing as a temporary dealer, be given an opportunity to continue as a permanent dealer; and to set aside the impugned notification.

Learned Government Pleader for Civil Supplies opposes the Writ Petition and submits that, if no BC-D group candidates come forward in respect of the subject vacancy, the authorities would take appropriate decision but, at this stage, it is premature for petitioner to assume that there would be no applications from BC-D (General) category and prays to dismiss the writ petition. Having considered respective submissions and, in the facts of the present case, petitioner has no vested right to continue as permanent dealer as he was appointed on temporary basis. Whether BC-D candidates are available in the Village; and applications would be received in

response to the impugned notification or not are all matters which are required to be considered by respondent No.2 as and when situation arises and, at this stage, this Court is not inclined to entertain the Writ Petition.

In the circumstances, the Writ Petition fails and is, accordingly, dismissed. However, it is made clear that the petitioner may be continued to discharge the functions till fresh appointment is made.

Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
