Petitioner challenges the letter dated 27.12.2010 of the District Collector-cum-Chairman of Hyderabad District Scheduled Castes Services Co-operative Society Limited, Hyderabad addressed to the Director, A.P. Directorate Medical and Health Transport, S.R.Nagar, Hyderabad. By this letter, the employer of the petitioner was informed that person, by name, Sri C.Suresh Kumar was sanctioned an amount of 1,25,000/- towards loan for setting up of DTP Unit and he defaulted in repayment of the loan and total loan amount accumulated would come to 2,08,295/-. As petitioner stood guarantor, the said amount was directed to be recovered from his salary. After filing of this writ petition, petitioner died on 20.05.2011.

On the last occasion, learned standing counsel for Scheduled Castes Services Co-operative Society was directed to obtain instructions as to whether retirement benefits were paid to the petitioner; whether the principal borrower paid amounts due and whether any amount is recovered from the petitioner. The explanation given in the two letters addressed to the learned standing counsel is not clear. However, it appears from those two letters that no amount was recovered as sought from the petitioner or from the original borrower and that after the death of the petitioner, terminal benefits were paid to his family members.

Having regard to the fact that petitioner died and that the terminal benefits were already paid to the family members of the petitioner, the cause in the writ petition does not survive. 4.
By recording the above, writ petition is dismissed as abated. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ___________________________ JUSTICE P.NAVEEN RAO kkm
