HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.7403 OF 2016 ORDER:

This writ petition is filed challenging the action of the respondents 3 and 4 in not supplying the essential commodities to the petitioner's Fair Price Shop No.615, Plot No.49, Shanti Nagar, Uppal Municipality, Ranga Reddy District and also in not permitting the petitioner to distribute the same to the ration card holders. It is the case of the petitioner that a show-cause notice dated 2.3.2016 was issued to the petitioner alleging certain irregularities and as a matter of fact the petitioner submitted his detailed explanation to the said show cause notice. In spite of the fact that the explanation has been submitted by the petitioner on 2.3.2016 meeting all the charges which are leveled against him, no enquiry and no final orders have been passed as on date and the authorization issued in favour of the petitioner is neither suspended nor cancelled. In those circumstances, petitioner seeks a writ of mandamus as stated above.

Having considered the submissions made on behalf of the petitioner and considering the fact that the show cause notice issued on 2.3.2016 to which the petitioner submitted his explanation on the same day, no useful purpose would be served by keeping the writ petition pending.

In those circumstances, there shall be a direction to the respondent No.3R.D.O to complete the enquiry and consider the explanation submitted by the petitioner and pass the final orders within a period of four weeks from today. With the above direction, the writ petition is disposed of. No order as to costs. In view of the disposal of the main writ petition, Miscellaneous petitions, if any pending in the writ petition, shall also be closed. ______________________________ CHALLA KODANDA RAM, J.
